Supervisor charged with criminal negligence in fatal Ontario tunnel accident

Authorities have charged a supervisor at an Ontario tunnelling company following a workplace accident that led to the death of one of its employees.

According to Peel Regional Police, the supervisor was arrested in late March and is now facing one count of criminal negligence causing death.

The police identified him as Joseph Di Millo, a project supervisor at Technicore Underground Inc.

“He was released and will attend the Ontario Court of Justice in Brampton at a later date,” the police said in its news release.

Di Millo’s arrest comes after a lengthy investigation into an industrial accident that occurred in an underground water chamber at Hurontario Street and Burnhamthorpe Road West, Mississauga.

Emergency responders were reportedly called to the site on December 2, 2022, after a pipeline undergoing maintenance ruptured and caused the chamber to rapidly fill with water.

Joaquim Silva, 54, was working within the chamber when the accident happened. Police said he sustained fatal injuries and was pronounced dead after rescuers managed to retrieve his body the following morning.

As part of the investigation by Peel Regional Police, Technicore Underground Inc was also served a criminal summons and is facing the same charge as Di Millo, according to the police.

The company, which bills itself as “the leading metro tunnel contractors in Ontario,” is slated to appear in the Ontario Court of Justice on May 31, 2024.
