HR managers should be wary of how the definition of ‘psychological injury’ varies according to jurisdiction.

    The lack of national definitions not only creates confusion for organisations, but it can also create similar confusion and even angst for targets who, based on advice or a diagnosis provided by a medical professional, may believe that they would be successful in lodging a claim.

    Given the differences that exist from State to State, it is important not only for organisations to provide managers and workers with an understanding of these differences, it is also important to ensure that any training provided addresses the various differences.

    It would also be a factor base on the employees performance and appraisals history whether Psychological injury exist. Given the employee had an incident which is beyond your control such as stolen personal properties including personal identification while at work hours. These insurances and insurers couldn't be sympathetic enough to lead you in circles, no clear direction/definition, creating confusion, looking for loopholes just not to further the employees workers compensation claim. As in fact all the certainty and clarity on the unfortunate events are seen without reasonable excuse. Say no to money making insurance company!

    The definition of a Psychological Injury can only be determined by your insurer, as it is their responsibility to determine if any such claim is valid. There are so many variables that go into making such a determination, that it is impossible to clearly define.
