Adverse action: The dark horse in downsizing?

Despite a number of high profile legal cases in recent months, employers are failing to undertake their due diligence when it comes to downsizing and are ignoring the high risk posed by adverse action claims.

    Currency of knowledge regarding the various legislative requirements and the carious decisions being made by Courts, Commissions and Tribunal should be essential in any organisation.

    Regular audits/assessments or reviews of organisational policies and procedures and assessments of individual knowledge particularly for those with line management responsibility or accountability for making HR related decisions is essential.

    It might be less of a financial burden to invest in proactive audit/assessment processes than to wait the outcome of a claim.
