Hong Kong employer cops two-year hiring ban for skipping local workers

A Hong Kong company has been barred from importing workers for two years after it failed to hire qualified local job seekers.

The Labour Department announced on September 29, 2026 that it had imposed an administrative sanction on Integ Limited under the Enhanced Supplementary Labour Scheme (ESLS) - a government program that lets employers bring in workers from outside Hong Kong when they cannot fill roles locally.

The deal comes with a condition: employers must give local workers first priority.

According to the Labour Department, its investigation found that Integ Limited had "breached the local recruitment requirements under the ESLS by failing to employ qualified job seekers for the post of general office clerk without reasonable excuse while applying for importation of labour."

The sanction was immediate and two-pronged. The Labour Department killed the company's pending ESLS application on the spot. Then it went further - imposing a two-year freeze on any future applications from the company to import workers under the scheme.

A Labour Department spokesman left little room for ambiguity. Employers applying to import workers under the ESLS "should strictly comply with the scheme requirements, including according priority to employing suitable local workers," the spokesman said.

The department also laid out the full menu of consequences available when an employer violates labour or immigration laws, ESLS requirements, or the Standard Employment Contract: terminating pending applications, pulling previously granted import approvals, and refusing to accept future applications.

The ESLS launched in September 2023 to help ease labour shortages across different sectors while protecting the priority of local hiring. More than 37,000 foreign workers have been brought into Hong Kong under the scheme since its launch, and the Labour Department has sanctioned several employers for similar breaches in recent months.

For HR teams weighing the ESLS to fill persistent vacancies in Hong Kong, the takeaway is straightforward: local recruitment is not a formality. Skip it, and the door shuts for two years.
