HR Compliance Guide: Balancing employee rights with employer duties

HR compliance is an area that can be neglected but it is an integral part of an employer’s responsibilities. A free whitepaper published by HRD in partnership with Employment Hero outlines the key areas New Zealand businesses need to be across to grow with confidence and make sure they comply with necessary HR law.

Leaders often overlook the role HR plays in keeping a business on the right side of the law. There are several pieces of legislation that grant minimum rights to employees. These include:

  • The Equal Pay Act 19721
  • The Wages Protection Act 19832
  • The Minimum Wage Act 19833
  • The Parental Leave and Employment Protection Act 19874
  • The Human Rights Act 19935
  • The Employment Relations Act 20006
  • The Holidays Act 20037
  • The Health and Safety at Work Act 20158
  • The Employment Relations Amendment Act 20199
  • The Privacy Act 20201

Employee rights

Minimum rights exist to protect both onsite and remote employees. The minimum rights of an employee include entitlement to a written employment agreement – this applies to every employee and should comply with the minimum entitlements stated by the law.

Collective agreements

Certain sectors might require negotiation of unique conditions through collective agreements. For instance, minimum wage is currently $18.90 an hour but if a collective agreement is in place it could require a higher per hour pay rate.
