FWC makes it easier for employees to claim illegal dismissal

Filing an application for illegal dismissal is now made easier as the Fair Work Commission (FWC) has made Form F8 available on its Online Lodgment Service (OLS).

Form F8, or the Apply for general protections – dismissal form, is used by terminated employees in filing a claim if they believe they were dismissed for an illegal reason under general protection laws.

With the form online, those who want to file a claim can easily make one on the OLS without needing to upload the form on the website.

"The online form has been developed as part of our commitment to continue improving the way we deliver our services to the community," the FWC said in a media release.

According to the FWC, the online form was designed with an auto-fill function to make it easier for those filing a claim. It also has prompts to help provide the information needed to make a complete application as well as links to other resources that might help the individual filing a claim.

Lodging a dismissal application

To lodge an application, users just need to set up an account at the OLS and follow the prompts to get started.

Using the OLS allows users to save applications and return to them later, view a history of submitted applications, and review and download previously filed claims, according to the FWC.

"After you lodge an application, you will receive a lodgment confirmation email. This includes a survey link you can use to provide feedback on the OLS," the commission said.

Other forms that can also be lodged using the OLS include:

  • Unfair dismissal application (Form F2) – online form
  • Unlawful termination application (Form F9) – upload form
  • Agreement approval application (Form F16) – online form
  • Application to stop bullying at work (Form F72) – upload form

"The OLS is now our preferred method of lodgment for available forms. We will continue to expand the range of forms that can be lodged online," the FWC said.
