What is the best way to minimise risk when an employer suspects the employee is under the influence of drugs and requests an IME but the employee reuses to attend at the time or the following day.

You must have robust policies that clearly define the requirements. The policy must also include consequences for non-compliance.

Our policies clearly state that a refusal is treated as a positive result.
Staff are subsequently stood down and an investigation is conducted.

A discipline hearing is then conducted.

Sanctions are then decided after the employee has been given an opportunity to provide an explanation.
